    • submit and manage requests for product customization, return and/or repair.

Legal basis: performance of a contract to which the data subject is party (Article 6(1)(b) GDPR). Where the processing of special categories of data (e.g., health data) is necessary to handle a request for assistance or for other purposes, the data subject’s consent will be requested pursuant to Article 9(2)(a) GDPR.

Retention: Data relating to registered users’ accounts will be retained until the user deletes the account. Ferragamo will delete the account if the user has had no interactions (such as making a purchase or opening a newsletter) for 7 years. Data relating to unregistered users will be retained for 7 years from the last interaction.

  • Sending commercial communications and newsletters using the automated contact methods (email, SMS, chat) and traditional methods (mail, telephone) selected by the user, and collecting users’ opinions regarding Ferragamo products and initiatives, including through surveys. This activity includes contacting a user who has completed a survey to address any dissatisfaction and, more generally, to improve Ferragamo services, including on the basis of aggregated statistical analyses. Feedback collected through surveys may also be processed using artificial intelligence-based systems.

Legal basis: the data subject’s consent (Article 6(1)(a) GDPR). The legal basis for analyzing responses for statistical purposes and to improve the Services is the pursuit of the Controller’s legitimate interest (Article 6(1)(f) GDPR).

Retention: Data will be processed until the user withdraws consent. If there are no interactions (such as a purchase or the opening of a newsletter) for 7 years, the user’s information will be deleted or anonymized. Consequently, no further commercial communications or newsletters will be sent to the data subject unless they expressly indicate that they wish to continue receiving communications or newsletters from Ferragamo.

  • Measuring campaign performance, optimizing deliverability, anti-spam and security measures, and personalizing subsequent communications by embedding tracking tools (so-called tracking pixels) in email communications.

Legal basis: the data subject’s consent (Article 6(1)(a) GDPR).

Retention: Data will be retained for a maximum of 7 years.

  • Sending email communications concerning Ferragamo products or services similar to those purchased or used on the Website

Legal basis: so-called “soft spam” (Article 130(4) of Italian Legislative Decree No. 196/2003).

Profiling activities may also be carried out using artificial intelligence-based systems, and data subjects’ data may also be processed to improve the effectiveness of such systems on the basis of the Controller’s legitimate interest. Solely for users who have consented to profiling, assistance activities before, during and after a purchase may also be carried out using artificial intelligence-based systems.

Legal basis: the data subject’s consent (Article 6(1)(a) GDPR).

  • Accessing content by interacting with the smart tag placed inside Ferragamo products using Near Field Communication (NFC) technology. As part of this activity, Ferragamo processes only general information relating to the device being used (device type, language and general IP-based location), without processing any ID relating to the user’s device.

Legal basis: performance of a contract to which the data subject is party (Article 6(1)(b) GDPR).

Retention: Data will be retained for 2 years from collection.

  • Combating and preventing counterfeiting of Ferragamo products by analyzing data concerning when and where a tag stored inside a Ferragamo product is read by a device through Near Field Communication (NFC) technology, in order to identify anomalies and clones. In particular, the device reads the tag ID and queries Ferragamo’s internal database, which then detects the device type, language and general IP-based location to determine whether products may be counterfeit (e.g., where the same tag has been read by two different devices located far from one another). This processing does not involve continuous location tracking or determine whether a specific product is counterfeit, and enables Ferragamo to collect general information relating to counterfeiting.

Legal basis: pursuit of the Controller’s legitimate interest (Article 6(1)(f) GDPR).

Retention: Data will be retained for 2 years from collection.

  • Browsing and interacting with Ferragamo Social Media Pages

Retention: Data will be retained for the period strictly necessary to interact with the user.

  • Complying with administrative, accounting and tax obligations and other legal obligations requiring Ferragamo, depending on the specific circumstances, to collect and/or process certain Personal Data, including compliance with product liability obligations for damage caused by defective products, where applicable.

Legal basis: compliance with a legal obligation to which the Controller is subject (Article 6(1)(c) GDPR).

Retention: Data will be retained for ten 10 years, which is the general retention period prescribed by law.

  • Establishing, exercising or defending the Controller’s legal rights (for this purpose, health-related data may also be processed where communicated by the data subject).

Legal basis: pursuit of the Controller’s legitimate interest (Article 6(1)(f) GDPR), as well as the data subject’s consent pursuant to Article 9(2)(a) GDPR with regard to the processing of health-related data.

Retention: Data will be retained for 10 years. In the event of litigation, data will be retained until the time limits for bringing appeals have expired.

  • Preventing and detecting misuse of the Website or fraudulent activities carried out through the Website, particularly in relation to payments. For further information, please refer to paragraph 5(b) below.

Legal basis: pursuit of the Controller’s legitimate interest (Article 6(1)(f) GDPR).

Retention: Data will be retained for 10 years.

5. Recipients of Personal Data

Personal Data may be shared, for the purposes referred to in paragraph 4 above, with the entities listed below (hereinafter jointly referred to as the “Recipients”):

  1. third parties appointed as processors pursuant to Article 28 GDPR, in particular hosting service providers or IT providers and companies providing technical maintenance services (including maintenance of network equipment and electronic communications networks). Personal Data may also be shared with other Group companies acting as processors, in accordance with the guidelines and instructions provided by the Controller;
  2. third parties acting as independent controllers, such as public authorities and professional firms authorized to receive Personal Data, as well as payment service and fraud-prevention providers used in the different markets in which the Group operates. In particular, depending on the country, Personal Data may be disclosed to Adyen N.V., including in connection with its “Revenue Protect” anti-fraud service (European Union, United States, Canada and Japan), Riskified Ltd for anti-fraud checks (European Union, United States, Canada and Australia), Cybersource Limited as payment service provider (Australia and Korea), and PayPal, Inc. The entities referred to above may be established outside the EU/EEA. Where data is transferred to countries not covered by an adequacy decision, the Controller will rely on an appropriate transfer mechanism under Article 46 GDPR (in particular, the Standard Contractual Clauses). Processing by the fraud-prevention service provider may take place in the United States and Israel, countries covered by adequacy decisions pursuant to Article 45 GDPR.

6. Data subject rights

Data subjects (i.e., the individuals to whom the data relates) may exercise the rights set out in Articles 15-22 GDPR by sending a communication to the contact points indicated in paragraph 1.

In particular, data subjects may obtain confirmation from the Controller as to whether or not Personal Data concerning them is being processed and, where that is the case: (i) access to such data and to the information referred to in Article 15 GDPR; (ii) rectification of inaccurate data; (iii) completion of incomplete data; (iv) erasure of data in the cases provided for by Article 17 GDPR; (v) restriction of processing in the cases provided for by Article 18 GDPR; and (vi) object, on grounds relating to their particular situation, to processing carried out on the basis of the Controller’s legitimate interest. In addition, where processing is based on consent or a contract and is carried out by automated tools, data subjects may request to receive the data in a structured, commonly used and machine-readable format and, where technically feasible, to have it transmitted to another controller without hindrance (“right to data portability”). Data subjects may withdraw their consent at any time. In particular, by using the “unsubscribe” links included in each email communication, they may choose either to withdraw consent to processing for marketing purposes, thereby stopping the receipt of commercial communications and newsletters, or to withdraw only consent to the use of tracking pixels while continuing to receive such communications.

In any event, data subjects have the right to lodge a complaint with the competent supervisory authority in the Member State of their habitual residence or place of work, or in the Member State where the alleged infringement occurred.

7. Changes

Ferragamo reserves the right to amend this Privacy Policy, in whole or in part, or simply to update its contents, for example following changes to applicable law. Ferragamo will inform users of any changes, which will become binding as soon as they are published on the Website. Ferragamo encourages data subjects to review this Privacy Policy regularly in order to remain informed about the methods adopted to process and protect Personal Data.
